Please read these Terms of Service ("Terms") alongside our Privacy, Shipping and Refund & Returns policies. By using retrowhale.com (the "Site") or ordering, you agree to them; if you do not agree, please do not use the Site.

The shop and placing an order

Retro Whale is the trade name of Circle Vioaza INC, based in Horn Lake, Mississippi. Our online shop sells wind spinners, wind chimes, garden stakes, and garden ornaments. You represent that you are at least 18 years old or have consent from a parent or legal guardian. Information you provide with an order must be accurate, current and complete. The range consists of wind spinners, wind chimes, garden stakes, and garden ornaments. Product pages show details such as size, materials and included items. Actual colors can differ slightly from images on a screen. We may modify, discontinue or update product listings at any time without advance notice. Delivery is within the United States, covering the 50 states. International shipping is unavailable. See the Shipping Policy for details.

Payment, delivery costs and order changes

Product prices on the Site are in US Dollars (USD). Applicable sales tax is excluded unless we state otherwise. Checkout displays the product price, shipping fees and taxes before you confirm the order. We may update prices at any time. Standard shipping within the United States is free, without a minimum order amount. Checkout displays the available payment methods. The payment processor used there handles payment securely. The charges appear before you confirm your purchase; there are no undisclosed fees. Contact support@retrowhale.com as soon as possible to request cancellation. An order that has been processed or shipped may no longer be eligible. We accept returns for manufacturing defects, damage in transit or an incorrect item received. Accounts, conduct and the content you see

If you create an account, keeping the login credentials confidential is your responsibility. Notify support@retrowhale.com immediately if you suspect unauthorized account access. You agree not to engage in unlawful or fraudulent activity, interfere with Site security or operation, scrape, copy or reproduce Site content without written permission, upload malicious software or harmful code, or try to gain unauthorized access to any part of the Site. Site content, including product images, text, logos and graphics, is owned by or licensed to Retro Whale and protected by applicable intellectual property laws. Reproducing, distributing or using that content requires our prior written consent.

Disclaimers, liability and personal information

The Site and products are provided "as is" and "as available." We work toward accuracy and reliability but do not guarantee uninterrupted or error-free operation, or that the Site is free of harmful components. To the fullest extent permitted by law, Retro Whale / Circle Vioaza INC is not liable for indirect, incidental, special, consequential or punitive damages resulting from use of the Site or purchase of products, including loss of data, revenue or profits. The Privacy Policy also governs use of the Site and explains the collection, use and protection of personal information.

Revisions, applicable law and correspondence

We may revise these Terms from time to time and post the changes here with a revised effective date. Continuing to use the Site after changes are posted means you accept the revised Terms. The laws of Mississippi and the United States govern these Terms. Disputes arising from these Terms or use of the Site shall be resolved in courts located in Mississippi.
